Kolkata: The Supreme Court on Wednesday, 23rd April declined to pause Bihar Public Service Commission mains examination scheduled for April 25th. Additionally, during a preliminary test on December 13 of last year, the court rejected petitions claiming a paper leak.

A panel consisting of Justices Manmohan and Dipankar Datta rejected multiple requests to cancel the 70th BPSC Combined Competitive Preliminary Exams. The court stated that there was a lack of conclusive evidence to warrant a re-test for all candidates.

Senior advocate Anjana Prakash, representing the petitioners, contended that digital evidence, including WhatsApp messages and video clips, indicated that question papers were leaked before the examination. She further alleged that one video purportedly showed answers being announced over loudspeakers at an examination center.

Solicitor General Tushar Mehta, representing the Bihar government and the BPSC, defended the integrity of the examination process. He clarified that in order to avoid uniformity, four distinct sets of question sheets were used, with the questions mixed around. Addressing concerns about similarities with coaching center materials, he clarified that only two out of the 150 questions were found to be identical copies.

The bench raised questions about how genuine and how far-reaching the presented digital evidence was. It pointed out that the allegations were limited to a single exam center at Bapu Pariksha Parisar, where a re-examination had already been conducted for the 10 thousand affected candidates. The court further observed that the leak seemed to have happened after candidates had already entered the exam rooms, according to the petitioners' own statements.

After appeals against the Patna High Court's decision, including one from the Anand Legal Aid Forum Trust, the Supreme Court issued its ruling. Since there was no concrete proof of malpractice at several test locations, the High Court had earlier rejected the petitions, enabling the BPSC to move forward with the mains exam.

On January 7th, a bench headed by then Chief Justice Sanjiv Khanna had declined to examine a plea regarding alleged irregularities in the BPSC exam held on December 13th, 2024, and the subsequent police action on protesters, advising the petitioners to approach the Patna High Court.

It has been reported that Bihar police used force to subdue civil service applicants who demanded that the December 13, 2024, BPSC exam be canceled. Following the initial allegations, the state public service commission ordered a re-examination held on January 4th at 22 centers in Patna for specific candidates.
